Terms and Conditions of Sale

2. Scope of Application
These General Terms and Conditions of Sale govern the offer and sale of products on the nottesud website (hereinafter "Website"). Every purchase made on the Website is governed by these conditions, which the consumer is required to fully accept at the time of placing the order.
These conditions apply to all purchases made by consumers pursuant to Art. 3, paragraph 1, letter a) of Legislative Decree 206/2005 (Consumer Code).
3. Products
The essential characteristics of the products are presented on their respective product pages on the Website. Images and descriptions reproduce the characteristics of the products as faithfully as possible; however, images are for illustrative purposes only and may show slight differences from the actual product (color, size, aesthetic details) due to the browser or device used.
Important: nottesud products are not medical devices. They are personal wellness items (home LED phototherapy) and do not replace the advice or treatment of a healthcare professional.
4. Prices
All prices indicated on the Website are expressed in Euros and include VAT. Shipping is free for all orders delivered in Italy and the European Union, with no minimum order value. For shipments to non-EU countries, shipping costs may apply, which will be calculated and indicated separately before order confirmation.
5. Payment Methods
Payment for products purchased on the Website can be made via:
- Shopify Payments (managed by Stripe): Visa, Mastercard, American Express, Apple Pay, Google Pay
- PayPal
Payment is charged at the time of order confirmation. All transactions take place via secure and encrypted connections. The Seller does not have access to complete payment card data.
6. Purchase Process and Contract Conclusion
Before proceeding with the purchase, the consumer is invited to consult the Pre-Contractual Information. The purchase process consists of: product selection, shipping/billing data, payment method choice, order summary review, confirmation, and order submission with payment obligation.
The order sent by the consumer constitutes a contractual proposal. The sales contract is concluded when the consumer receives the order confirmation email from the Seller.
7. Shipping and Delivery
Products are shipped to the address indicated by the consumer. Shipping is free in Italy and the EU. Delivery is expected within 15 working days from order confirmation, in accordance with Art. 61 of Legislative Decree 206/2005 (maximum legal term: 30 days).
Upon shipment, the consumer receives an email with the tracking number. Pursuant to Art. 63 of the Consumer Code, the risk of loss or damage transfers to the consumer when they physically take possession of the goods.
8. Right of Withdrawal
Pursuant to Arts. 52-59 of Legislative Decree 206/2005, the consumer has the right to withdraw from the contract within 14 calendar days from the date of delivery, without having to provide any reason.
How to exercise the right of withdrawal
Send a written communication to dmilitello04@gmail.com with: order number, purchase date, name and surname, address, explicit declaration of the will to withdraw.
Conditions for return
The product must be returned intact, unused (except as necessary to verify its nature and function), complete with all accessories and in its original packaging. Return shipping costs are borne by the consumer, unless otherwise indicated.
Refund
The Seller will refund all payments, including standard delivery costs, within 14 days of receiving the returned product or proof of its shipment, using the same payment method as the consumer.
9. Exclusions from the Right of Withdrawal
Pursuant to Art. 59 of the Consumer Code, the right of withdrawal is excluded in the following cases:
- Sealed goods that are not suitable for return for hygienic reasons or health protection and that have been opened after delivery
- Goods made to measure or clearly personalized
- Goods that are likely to deteriorate or expire rapidly
- Goods that after delivery are, by their nature, inseparably mixed with other goods
10. Legal Guarantee of Conformity
All products sold on the Website are covered by the Legal Guarantee of Conformity provided by Arts. 128-135 of the Consumer Code. The guarantee has a duration of 24 months from the date of delivery.
The consumer is required to report the lack of conformity within 2 months of discovery, by writing to dmilitello04@gmail.com.
In case of lack of conformity, the consumer has the right, in order, to: repair, replacement, price reduction, contract termination.
11. Returns and Refunds
To initiate a return procedure: send a request to dmilitello04@gmail.com with order number and reason, await instructions from the Seller, ship, keeping proof of shipment. The refund will be made via the same payment method.
12. Liability
The Seller is not liable for damages resulting from improper use of the products or failure to follow the instructions provided. Nottesud devices are wellness items and do not replace the advice of a healthcare professional; the consumer is invited to consult their doctor in case of skin conditions, pregnancy, breastfeeding, or photosensitive conditions before use.
13. Alternative Dispute Resolution (ADR)
Pursuant to Legislative Decree 130/2015, consumers residing in Europe can resort to alternative dispute resolution bodies (ADR) to resolve any disputes out of court.
Please note that the European Commission's ODR platform has been abolished by Regulation (EU) 2024/3228, effective March 20, 2025, and is no longer available.
For more information on ADR bodies available in Italy, the consumer can consult the website of the Ministry of Enterprises and Made in Italy (MIMIT).
14. Applicable Law and Competent Court
These Conditions are governed by Italian law. For any dispute, the Court of the consumer's place of residence or domicile shall have exclusive jurisdiction, pursuant to Art. 66-bis of the Consumer Code. If the buyer is not a consumer, the Court of Palermo shall have exclusive jurisdiction.
