1. Owner and Scope

These General Terms and Conditions of Sale ("Conditions") govern the sale of products through the website [INSERT DOMAIN, e.g., danieleai.com] (the "Site"), operated by MILITELLO DANIELE (sole proprietorship), VAT number 07288450823, with registered office at Via Vittorio Emanuele 112, 90020 Vicari (PA), Italy ("Dagrox", "we" or "us").

By purchasing on the Site, you declare that you have read and accepted these Conditions, the Privacy Policy, the Cookie Policy, and the Site Terms of Use.

2. Smart Products and Pre-Contractual Information

We sell tech/smart devices (glasses, rings, bracelets, scales, pens, earbuds with translation functions). The essential characteristics, the price in euros (VAT included where applicable), and additional costs/expenses are indicated on the product page and at checkout.
Images are for illustrative purposes only; minor differences may exist (color/packaging/firmware versions). Availability may vary; adding to the cart does not guarantee availability.

3. Order, Acceptance, and Contract Formation

Submitting an order ("Order") constitutes an offer to purchase.
The contract is concluded only when you receive our Order Confirmation via email. In case of total/partial unavailability, we will notify you: you can choose replacement, wait (pre-order if applicable), or a refund of any amounts paid for unfulfilled items.

4. Prices, Taxes, and Invoicing

Prices are in euros and include VAT where applicable; shipping costs and ancillary services are indicated at checkout.
Businesses/professionals requiring an invoice must enter their tax details at checkout (including Certified Email/Recipient Code). The electronic invoice is issued via SdI.

5. Payments

6. Delivery, Timelines, and Risk

7. Pre-orders

Some products may be available for pre-order. Availability dates are estimated and may vary; we will update you via email. Payment may be captured immediately or authorized depending on the method. You can cancel the pre-order until shipment has been notified.

8. Conformity, DOA, and Legal Guarantee

Upon delivery, check the condition of the products. If you find shipping damage or obvious defects, report it to the courier (if possible) and write to us within 48 hours at danielem0218@gmail.com with order number, description, and photos/videos.

Legal guarantee of conformity (consumers): 24 months from delivery (Articles 128–135-bis Consumer Code). In case of a lack of conformity, you are entitled – within legal limits – to repair/replacement free of charge, or a price reduction or termination of the contract.
Non-consumer customers (B2B): the guarantee under Articles 1490 et seq. of the Civil Code applies; notification within 8 days of discovery, guarantee 12 months unless otherwise agreed.

DOA (Dead On Arrival): if the product does not work upon first startup within 7 days of delivery, we will arrange for replacement or refund after verification (technical time: receipt, testing, outcome). Return costs are at our expense in case of confirmed DOA.

Warranty exclusions: damage from improper use or use not in accordance with the manual, impacts/falls, liquids beyond declared IP limits, tampering/unauthorized repairs, consumables (e.g., batteries beyond normal wear and tear), third-party software/apps, unofficial firmware modifications.

9. Software, Firmware, and Compatibility

Smart products may require third-party apps or accounts, software/firmware updates, Bluetooth/Wi-Fi connections, and minimum system requirements ([INSERT LINK/LIST OF REQUIREMENTS IF AVAILABLE]).
Functionalities dependent on third-party services (e.g., translation, cloud) may vary or cease due to provider decisions; this does not constitute a defect of conformity if the product maintains its essential stated functions. Security updates may be automatic.

10. Returns and Right of Withdrawal (Consumers)

You have 14 days from delivery to withdraw without giving any reason (Art. 52 et seq. Consumer Code), except for legal exceptions.

How to exercise the right of withdrawal:

  1. send an explicit declaration to danielem0218@gmail.com or Certified Email within 14 days (you can use the EU standard withdrawal form);

  2. return the products within 14 days of our receipt of the request to: [INSERT RETURN ADDRESS] indicating the order number.

Conditions: products must be intact, complete with packaging/accessories/manuals; responsibility and cost of return shipping are at your expense, unless the return is due to our defect/error. We may withhold the refund until we receive the goods or proof of shipment.
Refunds: paid price + initial standard shipping costs (if applicable); we do not refund extra costs for non-standard deliveries (e.g., express).
Exceptions: does not apply to personalized/custom-made goods, sealed goods opened after delivery that are not suitable for return for hygiene/health reasons (only if applicable to the type of product).

11. Returns due to Error, Missing Items, Refused Shipments

If you receive a product different from the one ordered or if items are missing, contact us within 48 hours with a photo of the package/packaging. In case of an incorrect/incomplete address, storage, or refusal of the package, we may charge new shipping costs or deduct actual costs from the refund.

12. Limitation of Liability

Without prejudice to consumer protection provisions and liability for defective products, we are not responsible for:

  • indirect/consequential damages (loss of profit/data/use);

  • disruptions attributable to third parties (couriers, gateways, app/smart service providers) or force majeure (e.g., natural events, network/supplier outages, authority measures).
    In any case, our overall liability, where applicable, shall not exceed the amount paid for the order from which the claim originates, except in cases of fraud or gross negligence.

17. Final clauses

The nullity/ineffectiveness of one clause does not invalidate the others. Failure to exercise a right does not constitute a waiver. The assignment of the contract without our written consent is prohibited.
